Owner Awarded $240,000 Against Tenant and Guarantors

In the case Merrick Blvd 9224 LLC against 92-24 Merrick Inc. Supreme Court confirmed a referee’s report that, after trial, awarded an owner $241,643.93 for rent owed by a commercial tenant and the lease guarantors. The court also confirmed the dismissal of the tenant’s counterclaims alleging constructive eviction, property damage and lost profits.

The case shows the importance of having guarantees and a well drafted lease that allows an owner to recover rent when the tenant abandons premises. A copy of the decision can be found here by clicking this link.
